General Terms and Conditions
for the online shop meineplaketten.de
§ 1 Scope
These General Terms and Conditions (“T&Cs”) of autoXperts GmbH, Frankfurter Straße 200, 63263 Neu-Isenburg (“Seller”) apply to all contracts concluded by consumers or traders (“Customers”) with the Seller via the online shop meineplaketten.de.
The following types of product in particular may be offered via the online shop:
- personalised physical products,
- non-personalised physical products,
- electronically provided products and services.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession.
A trader is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business or self-employed profession.
Deviating terms of the Customer are not recognised unless the Seller expressly agrees to their validity.
Contracts concluded via an area separately designated as a B2B shop are subject to the terms and conditions provided there.
§ 2 Conclusion of contract
The products presented in the online shop do not yet constitute a binding offer by the Seller, but enable the Customer to submit a binding offer.
The Customer can select the desired products and place them in the cart. Before completing the order, the Customer can review and, if necessary, correct their entries.
Before the order is submitted, the applicable T&Cs are made available to the Customer. The Customer confirms their validity in the course of the ordering process.
By clicking the final order button, the Customer submits a binding offer to conclude a contract for the products contained in the cart.
The order confirmation sent automatically immediately after receipt of the order initially merely confirms receipt of the order and does not yet constitute acceptance of the offer, unless acceptance is expressly declared therein.
The Seller may accept the offer in particular by an express confirmation of the order, by dispatching the ordered goods or, in the case of electronically provided products and services, by providing or performing them.
Where the means of payment used is already authorised or charged immediately after the order has been submitted, this alone does not constitute confirmation that a product can be provided irrespective of statutory or product-specific requirements.
If an order cannot be fulfilled and no contract is concluded, any amount already collected will be refunded without undue delay via the means of payment originally used.
In the case of products whose issue, manufacture or provision depends on statutory requirements or on specific vehicle data, processing requires that the information provided by the Customer is complete and accurate and that the relevant requirements are met.
This applies in particular to emissions stickers. If the check shows that the vehicle concerned does not meet the statutory requirements for the sticker ordered, the sticker ordered cannot be issued. The Customer will be informed accordingly. Any amount already paid will be refunded without undue delay via the means of payment originally used.
The text of the contract is stored by the Seller.
The information relevant to the contract, including the T&Cs applicable at the time of the order and, where required, the withdrawal instructions, will be made available to the consumer within the statutory time limits on a durable medium, in particular by e-mail or as a PDF document.
Where, when ordering electronically provided products or services, the consumer makes declarations regarding the early commencement of performance of the contract and its effects on their right of withdrawal, these declarations are also documented in accordance with the statutory requirements.
§ 3 Prices and terms of payment
The prices stated to consumers in the online shop are total prices and include the applicable statutory value added tax, insofar as value added tax is incurred.
Shipping costs may be charged in addition. Their amount will be displayed to the Customer before they submit their order.
Where the statutory requirements for a VAT-exempt supply are met for an order, the tax treatment may be adjusted accordingly.
This may be the case in particular for export deliveries to countries outside the European Union and for deliveries to traders in other Member States of the European Union, provided that the statutory requirements are met and the necessary evidence, in particular a valid VAT identification number, is available.
The total amount payable for the specific order will be displayed to the Customer before the order is submitted.
For deliveries to countries outside the European Union, customs duties, import taxes or other public charges may additionally arise. These are not levied by the Seller and are to be borne by the Customer, unless otherwise stated in the respective offer.
The following payment options in particular may be offered in the online shop:
- PayPal
- Credit card
- Apple Pay
- Google Pay
Depending on the payment method selected and on technical availability, payment is processed via PayPal and/or Stripe.
The payment options available in the individual case and the total amount payable will be displayed to the Customer during the ordering process.
The terms and conditions of the payment service provider used in each case apply additionally to the processing of payments.
Subject to obvious typographical, calculation and price-labelling errors. Our statutory right to avoid a declaration made as a result of such a mistake (Sections 119 et seq. of the German Civil Code, BGB) remains unaffected.
Vouchers and discount codes
A discount from a voucher or promotional code is allocated to the items in the order in proportion to their value. If the order for an item is cancelled, the right of withdrawal is exercised in respect of that item, or the item is returned, we refund the amount actually paid for it, i.e. the price less its share of the discount.
A redeemed promotional or discount code issued free of charge is considered used when the order is placed and will not be reactivated if the order is cancelled. If a partial cancellation causes the order value to fall below a minimum order value, the discount already granted is retained proportionately. This rule does not apply to commission credit from our referral programme. Its redemption, remaining balances and re-crediting are governed by the provisions on commission credit in the referral programme terms. Statutory rights arising from the reversal of a transaction remain unaffected.
One voucher or promotional code can be redeemed per order. Codes cannot be combined with one another and cannot be paid out in cash, unless otherwise stated.
§ 4 Delivery and provision
4.1 Physical products
Personalised and non-personalised physical products are sent to the delivery address specified by the Customer in the ordering process.
The processing, shipping and delivery times applicable to the respective product and the respective country of delivery are displayed with the product or during the ordering process.
For personalised products, processing begins after successful payment and after complete submission of the information and any evidence required for processing, checking or manufacture.
Delays for which the Customer is responsible in submitting required information or documents may lead to a corresponding delay in processing and delivery.
4.2 Electronically provided products and services
In the case of electronically provided products and services, there is no physical delivery unless otherwise stated in the respective product description.
Provision, activation, registration, transmission or other performance takes place in accordance with the conditions stated in the respective offer and during the ordering process.
Where certain information from the Customer is required for provision or performance, the Customer is obliged to provide it completely and accurately.
In particular in the case of products whose provision or use depends on data, periods, vehicle registration numbers, vehicle data or other information provided by the Customer, the Customer is responsible for carefully checking this information before completing the order.
Product-specific requirements, periods of validity, activation conditions or other special features are communicated to the Customer with the respective product or during the ordering process.
§ 5 Right of withdrawal for consumers
In the case of distance contracts, consumers are in principle entitled to a statutory right of withdrawal, unless a statutory exception applies or the right of withdrawal expires under the statutory conditions.
Details can be found in the withdrawal instructions provided in the online shop.
5.1 Non-personalised physical products
The statutory provisions on the right of withdrawal apply to non-personalised physical products.
5.2 Personalised physical products
There is no statutory right of withdrawal for contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer.
This includes in particular products made individually on the basis of the vehicle registration number, vehicle data or other individual information provided by the Customer.
5.3 Electronically provided products and services
The statutory provisions on the right of withdrawal and its expiry apply to electronically provided products and services.
If an order contains an electronically provided product or a corresponding service and special declarations by the consumer are required for early commencement of performance of the contract, these are obtained separately in the ordering process.
In particular, the consumer is asked to expressly consent to performance of the contract being started before the withdrawal period has expired and to confirm their awareness of the associated statutory effects on their right of withdrawal.
In the case of contracts for digital content not supplied on a tangible medium, the right of withdrawal may expire under the statutory conditions upon commencement of performance of the contract.
In the case of contracts for services, the right of withdrawal may expire under the statutory conditions upon complete performance of the agreed service.
The declarations required for the respective contract are only displayed to and requested from the consumer insofar as the order concerned contains a corresponding electronically provided product or a corresponding service.
The consumer is informed, in accordance with the statutory provisions, of the existence or non-existence of a right of withdrawal and of the conditions for any early expiry thereof.
§ 6 Retention of title
Physical goods remain the property of the Seller until the respective purchase price has been paid in full.
§ 7 Rights in respect of defects and complaints
The statutory rights in respect of defects apply.
This applies both to physical products and, where applicable, to electronically provided products and services.
In the case of personalised products, the Customer is obliged to enter the information required for manufacture carefully and completely.
A product is not defective insofar as a deviation is based solely on the Customer having provided incorrect data and the product having been properly manufactured or provided in accordance with that information.
Special features of emissions stickers
Before affixing a delivered emissions sticker, the Customer is asked to check it in particular for the following points:
- correct vehicle registration number,
- correct and complete lettering,
- legibility of the print,
- visible damage.
This request is not a precondition for asserting statutory rights in respect of defects and does not restrict them.
Damage caused solely by improper affixing or removal of the sticker after delivery and not based on a product, material or manufacturing defect already present at the time of delivery does not constitute a defect in the goods delivered.
In the event of complaints, the Customer can contact customer service:
Complaint form: meineplaketten.de/reklamation
E-mail: support@meineplaketten.de
§ 8 Liability
The Seller is liable without limitation in cases of intent and gross negligence.
In the event of a slightly negligent breach of material contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on compliance with which the Customer may regularly rely, the Seller is liable only for the foreseeable damage typical of the contract.
Otherwise, liability for damage caused by slight negligence is excluded.
The above limitations of liability do not apply
- in the case of damage resulting from death, personal injury or harm to health,
- in the case of claims under the German Product Liability Act (Produkthaftungsgesetz),
- in the case of fraudulent concealment of a defect,
- in the case of an expressly assumed guarantee, or
- insofar as liability is mandatory by law.
Insofar as the Seller's liability is excluded or limited, this applies accordingly to the Seller's employees, legal representatives and vicarious agents.
§ 9 Data protection
Information on the processing of personal data, in particular also on the processing of data by the payment service providers used, can be found in the Seller's current privacy policy, which is available in the online shop.
§ 10 Consumer dispute resolution
The Seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final provisions
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
In the case of consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
If the Customer is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship is the Seller's place of business, insofar as legally permissible.
Should individual provisions of these T&Cs be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
